(« SMT ») sis au 201 Main Street, Suite 102, Carbondale, CO 81623 (« Sponsor ») et est administré par National Sweepstakes Company, LLC sis au 1143 East union Street, Newark, NY 14513 (« Administrateur »).

CES RÈGLES OFFICIELLES : Voici les règles officielles qui régissent la relation entre les Participants (définie ci-dessous dans la section « Admissibilité ») et le Sponsor concernant la présente promotion (les « Règles officielles »). Le présent règlement officiel est disponible à l’adresse https://myolympicrewards.com/xh7mqcfc (« Site Web »). En acceptant le règlement officiel lors de la participation à la promotion, chaque participant accepte d’être lié par le présent règlement officiel, y compris les conditions d’inscription.

CALENDRIER DE LA PROMOTION : La promotion commence à 11 h 00 heure d’Europe centrale (« CET ») le 20 décembre 2024 et se termine à 23 h 59 CET le 15 janvier 2025 (la « Période de la Promotion »).  L’ordinateur du Sponsor est le dispositif officiel de chronométrage pour la résente promotion.

ÉLIGIBILITÉ : La présente promotion est ouverte uniquement aux résidents légaux de France ayant une adresse postale en France qui sont : (i) âgés d’au moins dix-huit (18) ans au moment de la participation ; (ii) qui sont membres du programme de récompenses MyOlympic™ (voir la section « Comment participer » pour plus de détails sur l’inscription) ; et (iii) qui disposent d’un accès à Internet et d’un compte de messagerie électronique valide et actif (dénommé individuellement, un « Participant »). Les employés du sponsor, de l’administrateur, de Samsung, du CIO et de chacune de leurs sociétés mères, filiales, sociétés affiliées, agences de publicité et de promotion respectives (dénommées collectivement, les « Entités de promotion ») et chacun des membres de leur famille immédiate (par ex., conjoint, parent, enfant, frère et sœur, et leurs conjoints respectifs et la famille par alliance de chacun, quel que soit leur lieu de résidence) ainsi que les personnes vivant dans le même foyer, qu’elles soient ou non liées, ne sont pas éligibles à participer ou à gagner. La présente promotion est assujettie à toutes les lois et réglementations pertinentes. La présente promotion n'est pas valable pour les personnes résidant en dehors de la France et dans tous les pays où elle est interdite ou restreinte par la loi.. L'acceptation du présent règlement officiel lors de la participation constitue l'accord total et inconditionnel du participant à ce règlement officiel et aux décisions et interprétations du sponsor, qui seront définitives et contraignantes pour toutes les questions liées à la promotion. En participant à la Promotion, vous confirmez avoir la capacité légale de participer à la Promotion (c’est à dire que vous avez l’âge et la capacité mentale suffisants et que vous avez le droit d’être légalement lié par le contrat). La victoire d’un prix est subordonnée au respect de toutes les exigences énoncées dans les présentes.

COMMENT PARTICIPER AU PROGRAMME DE RÉCOMPENSES MyOlympic’ (le « Programme de récompenses ») :  Pour vous inscrire au Programme de récompenses, vous devez créer un compte (« Compte ») en utilisant la méthode ci-dessous et confirmer votre acceptation des conditions générales du Programme de récompenses, disponibles sur https://www.info.myolympicrewards.com/loyalty-terms-fr.

Si vous êtes devenu membre du Programme de récompenses avant le début de cette Promotion, vous pouvez contourner les étapes précédentes en vous rendant dans l’onglet « DISCOVER » de votre Compte et en cliquant sur l’image de la Promotion. Suivez ensuite les instructions de la section « COMMENT PARTICIPER (INSCRIPTION INITIALE) » ci-dessous pour participer à la Promotion.

Pour créer un compte, visitez le site Web pendant lapPériode de promotion et inscrivez-vous au programme de récompenses en utilisant l’une des deux (2) méthodes ci-dessous :

(b)  ID SAMSUNG : Sélectionnez « CONTINUER AVEC L’ID SAMSUNG » et, lorsque vous y êtes invité, soumettez votre ID Samsung et votre mot de passe. Après avoir coché les cases indiquant que vous acceptez le présent Règlement officiel, les conditions d’utilisation et la politique de confidentialité du Sponsor, cliquez sur le bouton « CONTINUER ». Une fois vos informations envoyées avec succès, vous recevrez un courriel contenant un lien de connexion. Pour terminer la procédure d’inscription, vous devez cliquer sur le lien « Connexion » figurant dans le courriel.

REMARQUE : Si vous ne cliquez pas sur le lien « Se connecter » qui se trouve dans le courriel durant le délai indiqué, vous ne pourrez pas accéder à votre compte et/ou participer à la promotion.

COMMENT PARTICIPER (PARTICIPATION INITIALE) : Après votre inscription au Programme de récompenses et après avoir effectué toutes les étapes indiquées ci-dessus dans la section « Comment rejoindre le Programme de récompenses MyOlympic », vous recevrez automatiquement une (1) première participation (« Participation initiale ») à la Promotion. Si vous étiez déjà membre du programme de récompenses lors de votre visite sur le site Web, cliquez sur l’onglet « DISCOVER » de votre compte et cliquez sur le bouton « CONTINUER » pour recevoir une (1) participation initiale à la promotion. Limite d’une (1) participation initiale par participant.

COMMENT PARTICIPER (PARTIVCIPATIONS BONUS) Une fois la participation initiale reçue, les participants éligibles peuvent alors recevoir jusqu’à quatre (4) participations bonus par le biais de l’une ou de l’ensemble des méthodes suivantes. Pour gagner des participations bonus, visitez le site Web pendant la période de promotion et après avoir accédé à votre compte :

a.     Comment participer (1 participation bonus) : Lors de l’inscription à la promotion, les instructions « Comment participer » figureront sur l’écran. En naviguant sur les écrans, le participant recevra une (1) participation bonus à la promotion.

b.     Regarder (1 participation bonus) : Vous aurez également la possibilité de cliquer sur le bouton « REGARDER » pour regarder la courte vidéo d'information sur les Jeux olympiques.  En regardant la vidéo complète, les participants recevront une (1) participation bonus à la promotion.

c.     Sondage (1 participation bonus) : Cliquez sur le bouton « SONDAGE » et suivez les étapes pour répondre au bref sondage. À la fin du sondage, les participants recevront une (1) participation bonus à la promotion.

d.     Télécharger (1 participation bonus) : Cliquez sur l’un (1) des trois (3) boutons « TÉLÉCHARGER » disponibles pour recevoir une (1) participation bonus à la promotion. Vous n’êtes pas tenu de télécharger le fond d’écran pour recevoir la participation bonus par cette méthode. Si vous le souhaitez, suivez les liens et les instructions pour télécharger le fond d’écran.

Limite de participation :  Indépendamment de la ou des méthode(s) utilisées pour obtenir une participation à la présente promotion, il y a une limite de cinq (5) participations par personne pendant toute la période de la Promotion, ce qui équivaut à une (1) participation initiale et quatre (4) participations bonus.

Si le nombre de participations reçues provenant d'une même personne, d'un même numéro de téléphone et/ou d'une même adresse électronique est supérieur au nombre indiqué, les participations peuvent être annulées. Il est interdit aux participants d’utiliser plus d’une (1) adresse électronique, numéro de téléphone ou identités multiples. S'il s'avère ou si il existe des suspicions quant au fait qu'un participant utilise plus d'une adresse électronique ou plusieurs identités pour participer à la promotion, ce participant sera disqualifié. Les entités chargées de la promotion ne sont pas responsables des participations perdues, en retard, mal acheminées ou non livrables, que ce soit en raison d'erreurs de système, d'omissions, d'interruptions, de suppressions, de défauts, de retards de fonctionnement ou de transmission ou de toute autre raison, de vol ou de destruction ou de pannes, de transmissions défectueuses ou d'autres dysfonctionnements de télécommunication, les points non reçus résultant de défaillances matérielles ou logicielles de quelque nature que ce soit, de connexions réseau perdues ou indisponibles, de transmissions informatiques ou téléphoniques défaillantes, incomplètes ou déformées, d'erreurs et de défaillances typographiques ou systémiques, de dysfonctionnements techniques ou autres, dans chaque cas dans la mesure où ces éléments échappent au contrôle raisonnable des entités chargées de la promotion. Le sponsor ne vérifiera pas la réception des inscriptions pour les participants. En cas de litige concernant l’identité de la personne qui a participé à la présente promotion, la participation sera considérée comme soumise par le titulaire de compte autorisé (défini ci-dessous) de l’adresse électronique saisie lors de la réception de la participation initiale. Le « titulaire autorisé du compte » est défini comme la personne physique à laquelle est attribuée une adresse électronique par le fournisseur d'accès à l'internet, le fournisseur de services en ligne ou toute autre organisation (entreprise, établissement d'enseignement, etc.) chargée d'attribuer des adresses électroniques pour le domaine associé à l'adresse électronique communiquée.

TIRAGE AU SORT / NOTIFICATION :  Un (1) tirage au sort sera effectué dans le cadre de la présente promotion.  Le tirage au sort aura lieu dans les bureaux du Promoteur le 16 janvier 2025 à 00 h 01 CET. Les gagnants du grand prix (dénommé chacun, un « Gagnant du grand prix ») seront informés avant le 16 janvier 2025 à 9 h 00 CET. Pour le tirage au sort, le sponsor sélectionnera au hasard (à l’aide d’un logiciel électronique) seize (16) gagnants du grand Prix parmi toutes les participations valides et éligibles reçues pendant la période de promotion. Chaque gagnant du grand Prix recevra un grand prix (« Grand Prix »). Les possibilités de gagner un Grand Prix dépendent du nombre total de participations admissibles reçues pendant la période de promotion. La réception du prix par le gagnant du Grand Prix est soumise à la vérification de l’éligibilité (y compris une copie du passeport du gagnant du Grand Prix et/ou de la carte d’identité) et du respect du présent règlement officiel.

Notification / Vérification : Les gagnants du Grand Prix en seront informés par le sponsor par courriel avant le 16 janvier 2025 à 9 h 00 CET et devront répondre à la notification par courriel (« Notification par courriel ») avant le 19 janvier 2025 à 9 h 00 CET.

Dès réception de la notification par courriel, les gagnants du Grand Prix devront cliquer sur le lien figurant dans le courriel de notification qui les mènera à leur compte. En cliquant sur l’icône « GAGNANT », suivez les étapes pour remplir le formulaire d’échange de prix dans son intégralité, y compris votre prénom, nom, adresse, nom de la localité, code postal de la ville, numéro de téléphone et date de naissance.

Le sponsor tentera seulement à deux (2) reprises de joindre les gagnants du grand prix par le biais de la notification par courrier électronique dans un délai de soixante-douze (72) heures.. Dans le cas où un gagnant du Grand Prix ne répond pas dans un délai de soixante-douze (72) heures, le gagnant du Grand Prix original sera disqualifié, et un remplaçant sera sélectionné parmi les autres participations éligibles non gagnantes reçues pendant la période de promotion et notifiées comme indiqué ci-dessus. Si un gagnant du Grand Prix est disqualifié, jugé inéligible ou non conforme au présent Règlement officiel, ou refuse d’accepter le Grand Prix, le Grand Prix respectif sera attribué à un autre gagnant comme indiqué ci-dessus. 

Le sponsor tentera de notifier les gagnants du grand prix comme indiqué ci-dessus, mais le sponsor décline toute responsabilité en cas de courriel non délivré, y compris, mais sans s'y limiter, les courriels non reçus en raison des paramètres de confidentialité ou de filtre anti-spam du gagnant du grand prix, qui peuvent détourner tout courriel de la promotion, y compris tout courriel de notification du gagnant, vers un dossier de spam ou de courrier indésirable. Les décisions du sponsor relatives à la sélection des gagnants du grand prix sont fondées sur leur seule appréciation et interprétation du présent règlement officiel et sont définitives et contraignantes à tous égards. Si le ou les gagnants potentiels du grand prix initialement sélectionnés ne répondent pas ou sont jugés inéligibles conformément au présent règlement officiel, le sponsor notifiera jusqu'à trois (3) remplaçants.  Si, après avoir tenté de confirmer les remplaçants, les seize (16) gagnants du grand prix ne sont pas confirmés, les grands prix non réclamés ne seront pas attribués.

RÉCLAMATIONS DE PRIX :  Le sponsor est susceptible de demander à chaque gagnant du grand prix de prouver son éligibilité à la promotion (notamment en fournissant des copies de son passeport, de sa carte d'identité, de ses documents d'identité et/ou d'un justificatif de domicile). S'il s'avère qu'un gagnant du grand prix n'est pas éligible ou qu'il ne respecte pas le présent règlement officiel, le gagnant du grand prix perd son droit au grand prix et un autre gagnant sera notifié comme indiqué dans la section « Tirage au sort du grand prix/NOTIFICATION » ci-dessus, même si le nom du gagnant du grand prix disqualifié a été annoncé publiquement. Dans le cas où un gagnant du Grand Prix serait disqualifié en raison de son inéligibilité ou autrement du non-respect du présent règlement officiel, ni le sponsor ni l’administrateur n’auront de responsabilité ou d’obligation envers cette personne.

PRIX :  Seize (16) Grands Prix seront attribués dans le cadre de la présente promotion. La valeur au détail totale approximative (« VDA ») de chaque Grand Prix est de 1 621,70 €. La valeur au détail totale approximative de tous les prix à attribuer dans le cadre de cette promotion est de 25 947,20 €. Chaque Gagnant du Grand Prix recevra un (1) Samsung Galaxy Z Flip6 Édition Olympique avec étui pour téléphone et sac cabas en toile.

Les Grands Prix seront expédiés à chaque gagnant du Grand Prix avant le 7 mars 2025 ou dans les dix (10) jours ouvrables suivant la date à laquelle un autre gagnant du Grand Prix (le cas échéant) répond à la notification par courriel.

Informations générales sur le prix : Limite de seize (16) Grands Prix à attribuer dans le cadre de la présente promotion. Si, pour une raison quelconque, plus de notifications de prix sont envoyées (ou plus de réclamations sont reçues) que le nombre de prix offerts, comme indiqué dans le présent règlement officiel, le gagnant du Grand Prix sera le prénom sélectionné dans le tirage au sort correspondant. Aucun transfert ou substitution d’un Grand Prix n’est autorisé, sauf disposition contraire des présentes ou avec l’approbation préalable du sponsor. Sauf indication contraire dans les présentes, le Grand Prix non réclamé ne sera pas attribué. Tous les autres coûts et dépenses qui ne sont pas expressément énoncés dans les présentes relèveront de la seule responsabilité du gagnant du Grand Prix.

LIMITATION DE RESPONSABILITÉ : 

(a)  Aucune disposition du présent règlement officiel n'exclut ou ne limite la responsabilité du sponsor ou de l'administrateur en cas de : (i) décès ou dommages corporels causés par négligence ; (ii) fraude ou déclaration frauduleuse ; ou (iii) toute question à l'égard de laquelle il serait illicite d'exclure ou de restreindre la responsabilité.

(b)  Sous réserve des dispositions du point (a) ci-dessus, si le sponsor ou l'administrateur ne respecte pas le présent règlement officiel, le sponsor et l'administrateur (selon le cas) sont responsables des pertes ou dommages directs que vous subissez et qui sont le résultat prévisible de la violation du présent règlement officiel par le sponsor ou l'administrateur ou de la négligence du sponsor ou de l'administrateur, toutefois, le sponsor et l'administrateur ne seront pas responsables des pertes ou dommages indirects.

(c)   Ni le sponsor ni l'administrateur ne peuvent être tenus pour responsables de : (i) tout manquement au présent règlement officiel résultant d'événements échappant à leur contrôle raisonnable (i) tout manquement au présent règlement officiel résultant d'événements échappant à leur contrôle raisonnable, y compris, mais sans s'y limiter, toute défaillance des réseaux de communication résultant de circonstances échappant au contrôle raisonnable du sponsor ou de l'administrateur ; et/ou (ii) toute perte indirecte.

(d)  Vous reconnaissez et acceptez expressément que la promotion est gérée et mise à votre disposition par le sponsor et l’administrateur, à l’exclusion de toute autre entité. En conséquence, vous reconnaissez et acceptez en outre que les sociétés exclues ne sont pas parties au présent règlement officiel, et qu’elles n’auront aucune responsabilité envers vous, quelle qu’elle soit, dans le cadre de l’exécution de la promotion.

Si la promotion n’est pas en mesure de se dérouler comme prévu, y compris, mais sans s’y limiter, en raison d’une infection par un virus informatique, des bogues, des altérations, une intervention non autorisée, une fraude ou toute autre cause échappant au contrôle raisonnable du sponsor qui corrompt ou affecte l’administration, la sécurité, l’équité, l’intégrité ou le bon déroulement de la promotion, le sponsor se réserve le droit, à son entière discrétion, de résilier, modifier ou suspendre la promotion. Dans le cas où la promotion est résiliée prématurément, le sponsor sélectionnera les gagnants du Grand Prix parmi toutes les participations valides et éligibles reçues avant ladite résiliation. En aucun cas plus de prix ne seront attribués que ceux indiqués dans le présent règlement officiel. Dans le cas où, en raison d’erreurs techniques, typographiques, mécaniques, administratives, d’impression, de production, informatiques ou autres, il y a plus de gagnants que ce qui est indiqué dans le présent règlement officiel, le gagnant du Grand Prix sera le prénom sélectionné dans le tirage au sort correspondant.

TAXES : Le Grand Prix peut être considéré comme un revenu imposable en vertu des lois applicables au gagnant du Grand Prix. Dans la mesure où les lois applicables le permettent, toute taxe applicable au grand prix relève de la responsabilité unique et exclusive du gagnant du grand prix. Chaque gagnant du grand prix assumera l'entière responsabilité de la déclaration du grand prix aux autorités fiscales compétentes et du paiement de tous les impôts applicables au grand prix, conformément à la législation fiscale en vigueur. À la demande du sponsor, le gagnant du Grand Prix remplira et transmettra rapidement au sponsor tous les formulaires fiscaux, certificats, autorisations ou autres documents nécessaires afin de se conformer aux lois fiscales applicables. Si la loi l’exige, le sponsor se réserve le droit de retenir et de remettre aux autorités fiscales compétentes le montant de toute taxe ou taxe due. Dans le cas d'une personne imposable aux États-Unis (résidant aux États-Unis ou à l'étranger), le droit de recevoir le grand prix est subordonné à la soumission au sponsor, dans les dix (10) jours suivant la notification au gagnant du grand prix, d'un formulaire W-9 de l'IRS dûment rempli, comprenant le nom légal et le numéro d'identification du contribuable du destinataire légalement autorisé du grand prix.

LE DROIT APPLICABLE ET LA JURIDICTION COMPÉTENTE : Le présent Règlement officiel sera régi et interprété conformément au droit français et tout litige découlant du présent Contrat ou en relation avec celui-ci sera soumis à la compétence des tribunaux français.

Vous êtes en droit de porter tout litige pouvant survenir dans le cadre du présent règlement officiel devant, à votre entière discrétion, soit le tribunal compétent de France, soit le tribunal compétent de votre pays de résidence habituelle si ce pays de résidence habituelle est situé en France, lesquels tribunaux sont (à l'exclusion de tout autre tribunal) compétents pour trancher un tel litige. Nous porterons tout litige qui pourrait survenir en vertu du présent Règlement officiel devant le tribunal compétent de votre pays de résidence habituelle en France.

CONFIDENTIALITÉ :  Le recueil des données personnelles fournies dans le cadre de la présente promotion sera utilisé conformément aux politiques de confidentialité du Sponsor, disponibles en ligne sur https://www.smartmediatech.io/privacy-policy-french.

DROITS PUBLICITAIRES :  Chaque gagnant du Grand prix accepte de prendre part à une publicité raisonnable telle qu’exigée par le sponsor dans le cadre de la promotion. Dans le cas contraire, en participant à la promotion, chaque gagnant du Grand Prix autorise le sponsor à publier son nom et son pays de résidence s’il est gagnant de l’un des grands Prix, à moins que le gagnant n’informe le sponsor qu’il ne souhaite pas que ces données soient disponibles.

GÉNÉRALITÉS :  Toute tentative de participation à cette promotion autre que celle décrite dans les présentes est nulle. Le sponsor et l’administrateur se réservent le droit de disqualifier tout participant qui a été jugé ou soupçonné de falsifier le fonctionnement de la promotion, d’agir en violation du présent règlement officiel, ou d’agir de manière non sportive ou dans l’intention de perturber le fonctionnement normal de la présente promotion. S'il s'avère qu'une personne s'est inscrite ou a tenté de s'inscrire plus d'une fois en utilisant plusieurs numéros de téléphone, adresses électroniques, adresses résidentielles, identités multiples, adresses IP, utilisation de serveurs proxy ou autres méthodes similaires, toutes les inscriptions de cette personne seront déclarées nulles et non avenues et cette personne ne recevra aucun prix auquel elle aurait pu prétendre. Toute utilisation de méthodes robotiques, automatiques, macro, programmées, tierces ou similaires pour participer à la promotion annulera toute tentative de participation effectuée par ces méthodes et la disqualification de la personne qui les utilise. Attention :  Toute tentative d’endommager délibérément un site Web ou de saper le fonctionnement légitime de la promotion peut constituer une violation des lois pénales et civiles. Nous nous réservons nos droits en lien avec de telles violations, y compris pour demander des dommages-intérêts ou d’autres recours à toute personne responsable dans toute la mesure permise par la loi. (“SMT”) located at 201 Main Street, Suite 102, Carbondale, CO 81623 (“Sponsor”) and is administered by National Sweepstakes Company, LLC located at 1143 East union Street, Newark, NY 14513 (“Administrator”).

THESE OFFICIAL RULES: These are the official rules that govern the relationship between Entrants (defined below in the “Eligibility” section) and Sponsor in respect of this Promotion (the “Official Rules”). These Official Rules can be found at https://myolympicrewards.com/xh7mqcfc (“Website”). By accepting the Official Rules while entering the Promotion, each Entrant agrees to be bound by these Official Rules, including entry requirements.

PROMOTION TIMING: The Promotion begins at 11:00 AM Central European Time (“CET”) on December 20, 2024 and ends at 11:59 PM CET on January 15, 2025 (the “Promotion Period”).  The Sponsor’s computer is the official time keeping device for this Promotion.

ELIGIBILITY: This Promotion is open only to legal residents of France with a postal address in France who are: (i) at least eighteen (18) years old at the time of entry; (ii) who are a member of the MyOlympic™ Rewards Program (see “How to Participate” section for further details of sign up); and (iii) who have internet access and a valid and active email account (each, an “Entrant”). Employees of Sponsor, Administrator, Samsung, the IOC, and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies (collectively, “Promotion Entities”) and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win. This Promotion is subject to all relevant laws and regulations. This Promotion is void for residents outside France and anywhere else where it is prohibited or restricted by law. Acceptance of such Official Rules while participating constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions and interpretations, which are final and binding in all matters related to the Promotion. (b)  SAMSUNG ID: Select “CONTINUE WITH SAMSUNG ID” and when prompted, submit your Samsung ID and password. After checking the boxes indicating your agreement to these Official Rules, the Sponsor’s terms of use and privacy policy, click the “CONTINUE” button. Upon the successful submission of your information, you will receive an email with login link. To complete the registration procedure, you must click the “Login” link found within the email.

NOTE: If you do not click the “Login” link found within the email within the indicated time-period you will not be able to access your Account and/or participate in the Promotion.

HOW TO PARTICIPATE (INITIAL ENTRY): Upon successful registration for the Rewards Program and completing all the steps indicated above in the “How to Join The MyOlympic™ Rewards Program” section, you will automatically receive one (1) initial entry (“Initial Entry”) into the Promotion. If you were an existing Rewards Program member upon visiting the Website, click the “DISCOVER” tab in your account and click the “CONTINUE” button to receive one (1) Initial Entry into the Promotion. You are not required to download the wallpaper to receive the Bonus Entry via this method. If desired, follow the links and follow the instructions to download the wallpaper.

Entry Limit:  Regardless of the method(s) used to obtain entry into this Promotion, there is a limit of five (5) entries per person during the entire Promotion Period, equivalent to one (1) Initial Entry and four (4) Bonus Entries.

If more than the stated number of entries is received from the same person, telephone number and/or e-mail address the entries may be disqualified. Entrants are prohibited from using more than one (1) e-mail address, telephone number, or multiple identities. If it is found or suspected that an Entrant is using more than one e-mail address or multiple identities to participate in the Promotion, then that Entrant, will be disqualified. Use of any automated system to participate in the Promotion is prohibited and may result in disqualification. RANDOM DRAWING / NOTIFICATION:  There will be one (1) random drawing held in this Promotion.  The random drawing will take place at the offices of the Sponsor on January 16, 2025, at 12:01 AM CET The grand prize winners (each, a “Grand Prize Winner”) will be notified by January 16, 2025 at 9:00 AM CET. For the drawing, Sponsor will randomly (using electronic software) select sixteen (16) Grand Prize Winners from all valid and eligible entries received during the Promotion Period. Each Grand Prize Winner will receive a grand prize (“Grand Prize”). The odds of winning a Grand Prize depend on the total number of eligible entries received during the Promotion Period. Receipt of prize by Grand Prize Winner is subject to verification of eligibility (including a copy of the Grand Prize Winner’s Passport and/or ID card) and compliance with these Official Rules.

Notification / Verification: The Grand Prize Winners will be notified by the Sponsor via email by January 16, 2025, at 9:00 AM CET and must respond to the email notification (“Email Notification”) by 9:00 AM CET on January 19, 2025.

Upon receipt of the Email Notification, the Grand Prize Winners will be required to click the link found within the Email Notification which will lead them to their Account. Upon clicking the “WINNER” icon, follow the steps to complete the prize redemption form in its entirety including your first name, last name, address, locality name, town post code, telephone number and date of birth.

Sponsor will only make two (2) attempts to reach the Grand Prize Winners via the Email Notification within a seventy-two (72) hour time frame. In the event a Grand Prize Winner does not respond within a seventy-two (72) hour time frame, the original Grand Prize Winner will be disqualified, and an alternate will be selected from the remaining non-winning eligible entries received during the Promotion Period and notified as outlined above. If a Grand Prize Winner is disqualified, found to be ineligible or not in compliance with these Official Rules, or declines to accept the Grand Prize, the respective Grand Prize will be awarded to an alternate winner as outlined above. 

Sponsor will attempt to notify the Grand Prize Winners as set forth above, but Sponsor is not responsible for any undelivered e-mails, including without limitation e-mails that are not received because of the Grand Prize Winner’s privacy or spam filter settings which may divert any Promotion e-mail, including any winner notification e-mail, to a spam or junk folder. The Sponsor’s decisions with respect to the selection of the Grand Prize Winners shall be based on their sole discretion and interpretation of these Official Rules and are final and binding in all respects. If the originally selected potential Grand Prize Winner(s) do not respond or are deemed ineligible in accordance with these Official Rules, the Sponsor will notify up to three (3) alternates.  If, after attempting to verify alternates, all sixteen (16) Grand Prize Winners are not confirmed, the unclaimed Grand Prizes will not be awarded.

PRIZE CLAIMS:  Each Grand Prize Winner may be required by the Sponsor to demonstrate their eligibility for the Promotion (including by providing copies of his/her passport, ID card, identity documents and/or proof of address). If it is determined that a Grand Prize Winner is not eligible or otherwise not in compliance with these Official Rules, the Grand Prize Winner forfeits his/her right to the Grand Prize and an alternate will be notified as outlined in the “WINNINGRANDOM DRAWING/NOTIFICATION” section above, even if the disqualified Grand Prize Winner’s name may have been publicly announced. In the event a Grand Prize Winner is disqualified as a result of being ineligible or otherwise not in compliance with these Official Rules, neither Sponsor nor Administrator shall have any liability or obligation to such individual.

PRIZE:  There will be sixteen (16) Grand Prizes awarded in this Promotion. The total approximate retail value (“ARV”) of each Grand Prize is €1,621.70. The total ARV of all prizes to be awarded in this Promotion is €25,947.20. Each Grand Prize Winner will receive one (1) Samsung Galaxy Z Flip6 Olympic Edition with accompanying phone case and canvas tote bag.

The Grand Prizes will be shipped to each Grand Prize winner by March 7, 2025 or within ten (10) business days from the date in which an alternate Grand Prize Winner (if applicable) responds to the Email Notification.

General Prize details: Limit of sixteen (16) Grand Prizes to be awarded in this Promotion. If, for any reason, more prize notifications are sent (or more claims are received) than the number of prizes offered, as set forth in these Official Rules, the Grand Prize Winner will be the first name selected in the corresponding random drawing. No transfer or substitution of a Grand Prize is permitted, except as otherwise provided herein or with Sponsor’s prior approval. Except as otherwise set forth herein, unclaimed Grand Prize will not be awarded. All other costs and expenses not expressly set forth herein shall be solely Grand Prize Winner’s responsibility.

LIMITATION OF LIABILITY: 

(a)  Nothing in these Official Rules excludes or limits the Sponsor’s or the Administrator’s liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter in respect of which it would be unlawful to exclude or restrict liability.

(b)  Save as set out in (a) above, if the Sponsor or the Administrator fail to comply with these Official Rules, the Sponsor and Administrator (as applicable) are responsible for direct loss or damage you suffer that is a foreseeable result of the Sponsor’s or Administrator’s breach of these Official Rules or the Sponsor’s or Administrator’s negligence, but the Sponsor and the Administrator are not responsible for any indirect loss or damage.

(c)   Neither the Sponsor nor the Administrator shall be liable for: (i) any failure to comply with these Official Rules as a consequence of events beyond their reasonable control including without limitation, any failure of communication networks as a consequence of any circumstances beyond the reasonable control of the Sponsor or the Administrator’s; and/or (ii) any indirect loss.

(d)  You expressly acknowledge and agree that the Promotion is operated and provided to you by the Sponsor and the Administrator, and not by any other entity. Accordingly, you further acknowledge and agree that the Excluded Companies are not party to these Official Rules, nor shall they have any liability towards you whatsoever in connection with operation of the Promotion.

If, the Promotion is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole and absolute discretion, to terminate, modify or suspend the Promotion. In the event that the Promotion is terminated early, the Sponsor shall select Grand Prize Winners from among all valid and eligible entries received prior to such termination. In no event will more prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, the Grand Prize Winner will be the first name selected in the corresponding random drawing.

TAXES: The Grand Prize may be taxable income under the laws applicable to the Grand Prize Winner. To the extent permitted by applicable laws, any taxes applicable to the Grand Prize are the sole and exclusive responsibility of the Grand Prize Winner. Each Grand Prize Winner is solely responsible for reporting the Grand Prize to the relevant tax authorities, and paying all taxes applicable to the Grand Prize, as required by the applicable tax laws. Upon request from the Sponsor, the Grand Prize Winner will promptly complete and submit to the Sponsor all tax forms, certificates, authorisations or any other documents as may be necessary to comply with the applicable tax laws. If required by law, the Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any tax or taxes due. For any United States taxable person (resident in the US or abroad), the right to receive the Grand Prize is contingent on submission of a properly completed IRS Form W-9, including the legal name and taxpayer identification number of the legally authorized recipient of the Grand Prize to the Sponsor within ten (10) days of notification to the Grand Prize Winner.

GOVERNING LAW AND JURISDICTION: These Official Rules shall be governed by and construed in accordance with French law and any dispute arising out of or in connection with this Agreement shall be subject to the jurisdiction of the French Courts.

You may bring any dispute which may arise under these Official Rules to, at your discretion, either the competent court of France, or to the competent court of your country of habitual residence if this country of habitual residence is within France, which courts are (with the exclusion of any other court) competent to settle any such a dispute. We will bring any dispute which may arise under these Official Rules to the competent court of your country of habitual residence within France.

PRIVACY:  The collection of personal information provided in connection with this Promotion will be used in accordance with the Sponsor’s privacy policies located online at https://www.smartmediatech.io/privacy-policy-french.

PUBLICITY RIGHTS:  Each Grand prize Winner agrees to take part in reasonable publicity as may be required by Sponsor in respect of the Promotion. Otherwise, by entering the Promotion each Grand Prize Winner gives Sponsor permission to publish their surname and county of residence if they are a winner of one of the Grand Prizes unless the winner notifies Sponsor that they do not wish us to make these details available.

GENERAL:  Any attempted form of participation in this Promotion other than as described herein is void. Sponsor and Administrator reserve the right to disqualify any Entrant found or suspected to be tampering with the operation of the Promotion; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Promotion. If it is discovered that a person has registered or attempted to register more than once using multiple phone numbers, e-mail addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s entries will be declared null and void and that person will not be awarded any prize that he/she might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Promotion will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same. Caution:  Any attempt to deliberately damage any website or undermine the legitimate operation of the Promotion may constitute a violation of criminal and civil laws. We reserve our rights in relation to any such violations, including to seek damages or other remedies from any such person(s) responsible to the fullest extent permitted by law. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No Entrant shall have the right to modify or amend these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All entries and/or materials submitted become the property of Sponsor and will not be returned.
